The Radio Equipment Directive requires radio equipment to use the radio spectrum effectively and support its efficient use. About the Radio Equipment Directive 2014/53/EU. The EU’s Radio Equipment Directive (RED) was introduced in 2016 to establish manufacturing standards for radio products relating to their health and safety, electromagnetic compatibility (EMC) and efficient use of the radio spectrum. Now, our community has the European Union’s new Radio Equipment Directive 2014/53/EU (RED) to grapple with. The RED came into force on 13th June 2016, replacing the Radio and Telecommunications Terminal Equipment Directive (R&TTE Directive 1995/5/EC). Directive 2014/53/EU (Radio Equipment Directive [RED]) replaced the previous directive 1999/5/EG (Radio Equipment and Telecommunications Terminal Equipment Directive [R&TTED]) on 13 June, 2016; both directives can be applied until the end of the transition period on 12 June, 2017. As of 13 June, 2017, all products regulated European Union Directives like the Electromagnetic Compatibility (EMC) Directive (2014/30/EU) and the Radio Equipment Directive (2014/53/EU) are part of the EU legislative package (the New Legislative Framework (NLF)) for the Single Market for Goods.

Even though both directives broadly cover the same aspects, there are some major differences between the two: Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC Text with EEA relevance. Applicable as of 13 June 2016. In order to avoid unnecessary barriers to trade in radio equipment within the internal market, Member States should notify, under Directive 98/34/EC of the European Parliament and of the Council (9), other Member States and the Commission of their projects in the area of technical regulations, such as radio interfaces, unless those technical regulations allow Member States to comply with binding Union acts such as Commission decisions on the harmonised use of radio spectrum adopted under DIRECTIVE 2014/53/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 16 Apr il 2014 on the har monisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC dopted in 2014, transposed into European Union (EU) Member State legislation in 2014-16 and then subject to a transitional phase-in that ran until the end of 12 June 2017, the EU’s Radio Equipment Directive (RED) is not new legislation. Even so, its manufacturer obligations have only had mandatory application over the last couple of years. The origin of these issues lies in one article of the Radio Equipment Directive (2014/53/EU) which was passed in 2014.
